My spouse lives in Idaho and I live in california.......we got married nov, 6th of 2007 and seperated Nov, 22nd of 2007(not legally).....can i still get an anullment? He wont give me his address, and can I file for divorce in california or do i have to go there?How do i get a divorce without the address of my spouse?
A nullity has nothing to do with the amount of time you have been married. Bigamous marriage, age at time of marriage, unsound mind, physical incapacity, fraud, force, incestuous marriage..these are grounds for filing a nullity.
Procedurally, in California you have to be a resident of the state for 6 months and a resident of the county you are going to file in for 3 months. You don't need the other party's address to file for divorce. What you do need though is an order for publication signed by the Judge and then to have the petition/summons published in the newspaper in the state/county where the other party last resided.

A divorce is different than an annulment. Annulments make it so that the marriage never happened, a divorce means that you were married but it was dissolved. Annulments are a bit more difficult to get than divorces, it just all depends on the situation and reasons....
You would need to file in your state of residency, where you have lived for the past 6 months.
If you cannot find him, you will need to place a Notice of Publication in your local newspaper. Have it run for 30 days, then bring proof of that notice back to the court with the divorce papers. This will be considered as you ';serving him';. If he doesn't respond, then the divorce will most likely be granted by default. Contact your court house to see which papers they'll accept.
