Do I need to pay back the Navy BAH if my spouse is in jail?

I stayed in the barracks while collecting BAH because I was married. My spouse was in jail at that time so I was unable to send him money. Now that he is getting out, I can send him support again. Will he Navy ask for me to pay back the BAH I recieved while my husband was in jail?Do I need to pay back the Navy BAH if my spouse is in jail?
hmm.. you were entitled to BAH because you are married. regardless of his status.





HOWEVER.. unless you had unaccompanied orders you were NOT entitled to live in the barracks and collect BAH at the same time. not unless you got an exception to policy. That's where they'd get you for repayment.

No. You are married to him so you are allowed to stay in housing. When he goes over seas and you are alone you can still stay there. If you were single and getting the housing benefits then yes you would have to pay it back.
